What is the difference between Trust, Society, and Section 8?
Trust: Governed by Indian Trusts Act, 2 members minimum. Society: Governed by Societies Registration Act, 7 members minimum. Section 8: Companies Act, limited liability, no shareholders. All three can get 12A/80G.
Is 12A registration mandatory for NGOs?
No, but without 12A, your NGO income will be taxed at 30%. 12A registration provides full income tax exemption. It is highly recommended for all non-profits.
Can foreign donations be accepted without FCRA?
No. Accepting foreign contributions without FCRA registration is a criminal offense under FCRA Act. Penalties include imprisonment up to 5 years.
